Harmony Systems, Inc. Privacy Notice

This Privacy Notice (“Notice”) applies to the websites and mobile applications of Harmony Systems, Inc. (“we”, “us” or “our”) that display this Notice (each a “Site” and collectively, the “Sites”).

This Notice only applies to the Sites and does not apply to information gathered by other means or by third parties. This Notice does not apply to anonymized or aggregated data that does not allow individuals to be identified or contacted. Our Sites are not directed to children under the age of 13. We do not knowingly collect personal information from children under age 13.

1. Information We Gather

Information You Give Us. We may collect and retain information which you or your devices provide to us when you visit our Sites, including personal information. This information may relate to:

  • browsing or viewing our Sites;
  • your purchases or use of our products or services, including our mobile applications, iBooks, or eBooks; and
  • your communications with us, such as to provide feedback, request support, publicly comment on a blog, or ask for additional information.
Information we collect may include information such as first and last name, business, home or other physical address (including street name and city or town), email address, Twitter or other social media handle, phone number(s), payment information, or other information.

Automatically Collected Information. We may collect information about you and your devices automatically when you visit our Sites, including information such as:

  • your IP address;
  • the type of browsers, devices and operating systems you use;
  • identifiers associated with the devices you use to access our Sites;
  • the pages you visit and the features you use on our websites, including dates and times;
  • if you navigated from or navigate to another website, the address of that website; and
  • information regarding your internet service provider.
In addition, we may collect information about your activities on our Sites through the use of cookies, clear GIFs or web beacons, local shared objects or Flash cookies, or through other identifiers or technologies, including similar technologies as they may evolve over time. We refer to these technologies collectively as “Data Technologies.”

We may allow third parties to use Data Technologies on our Sites. Thus, when using our Sites, third parties may collect personally identifiable information about your activities over time and across different web sites. The information collected by Data Technologies may be shared with and used by us, by others acting on our behalf, or by third parties subject to their own privacy policies. Information collected by Data Technologies may be used on our Sites or on other websites or services, including those that may not be operated by us.

We do not automatically collect and receive information related to your ordinary use of our mobile applications. However, our mobile applications may provide you the ability to initiate a support email request to us. When you use this functionality, technical and log information from your device may be provided to us. In addition, we may receive certain information from the mobile application platform (such as Apple) relating to our mobile applications, such as crash reports. Through your mobile device settings, you may have options to limit this information sharing from your mobile application (see below, Choices Regarding Your Information).

Information from Other Sources. We may obtain information about you from third parties. This information may include information about your use of our Sites or our services, your use of other websites, your interests and preferences and other information about you. We may combine the information we obtain from third parties with information that we have gathered about you.

2. How We Use Information We Gather

We and others acting on our behalf may use and retain the information that we gather to operate our business, including our Sites, and for other purposes. For example, we may use the information that we gather to fulfill orders, help license software that you have purchased, provide assistance that you request, or to diagnose or address technical problems in the operation of our Sites or services. We may also use the information that we gather in order to technically evaluate and improve our Sites and services or to develop new products or services. When you email us from a mobile application for support, or if we receive technical information from a mobile application platform (such as a crash report or log relating to a technical issue), we may use this information to help troubleshoot your problem and to improve the quality of our software. We may use third party analytics tools on our websites in order to better understand our website visitors and their interests. In addition, we may use the information we collect or receive to:

  • offer, provide, or personalize products and services from us or third parties
  • communicate with you through telephone, email, text message, push notifications, direct mail, or using other contact information we may have for you, as permitted by law
  • investigate suspected misconduct or violation of our policies, and
  • protect the legal rights or interests of ourselves or others
We may use the information we gather for other purposes where we have individual consent. Please note that other parties may collect personally identifiable information about your online activities over time and across different websites when you use our Sites.

3. How We May Share Information

We share information to support the purposes for which we may use information as described or permitted by this Notice. For example, we may share information with third party service providers who help us operate our Sites, provide services or fulfill orders on our behalf, or otherwise support our business. When you place an order with us, your payment information may be provided directly to our service providers. Our service providers may include analytics companies, advertising networks, and others that provide Data Technologies on our Sites. We may use content or embedded software, objects, or controls from third parties on our websites (such as a video or audio player). By using such content or embedded software, objects, or controls, we may exchange information with these third parties, and they may learn information about your use of our websites. We may share information about videos you have viewed or audio you have listened to on our websites with (or obtain information about your video viewing from) analytics providers, advertising partners and other third-parties.

We may also share information with third parties to help us promote our products and services, or to help us customize advertisements, offers, or other communications. We may identify your use of our Sites across devices, and we may use information we collect from you and receive from others to optimize your use of our Sites and our services as you use different devices. We may share information with companies in the mobile app industry (such as carriers, operating system and platform developers, and app stores). On occasion, these and other business partners may offer you additional products or services that may be of interest to you.

In addition, we may share information we have gathered in connection with the sale or merger of all or part of our business or the transfer of assets. We may also use and share the information we gather to enforce our rights and protect our property, to comply with applicable law and legal process, to obtain legal advice and to prevent fraud, theft, and injury to you, us or others.

4. Choices Regarding Your Information

Your browser and your device may provide you the option to limit the use of cookies or other Data Technologies. You should consult documentation for your browser or device for more information. You may not be able to use all features of our Sites if you limit the information you share with us.

If we send you promotional emails, those emails may include an option to unsubscribe, as required by law. You may not opt out of transactional or administrative emails from us (such as emails regarding your orders or support requests).

As described above, our mobile applications may collect information from you if you send us a support email from within the mobile application (which may include application log information regarding the use of the mobile application), or through technical reports provided to us through the mobile application platform. You may be able to opt out of this information sharing by not sending us support emails, choosing not to include log information, or opting out of technical or error information-sharing on your mobile device or related app platform. You may opt out of all collection of information from our mobile applications by uninstalling the application from your mobile device. However, this will not restrict information collected from our website if you access our website from your mobile device.

5. California Do Not Track Disclosures

As of the Effective Date listed above, there is no commonly accepted response for Do Not Track signals initiated by browsers. Therefore, we do not respond to such signals or to other mechanisms that provide the ability to exercise choice regarding the collection of personally identifiable information regarding your online activities over time and across third party websites or online services.

When we make material changes to this Notice, we will update this web page and change the Effective Date listed above.
